Southaven MS Teacher Caught Having Sex In Car

Tyler Bigham, 22, of Southaven has been charged with sexual battery for having sex with a 17-year-old student. Bigham and the student were caught by a police patrol at the baseball complex in Snowden Grove Park, south of Goodman on Airways, at 9:22 p.m.

Southaven officers say they were on routine patrol at the huge Snowden Grove Baseball Complex about half past nine, when they noticed a couple of vehicles in a back parking lot. They found Bigham having sex with the 17-year-old student.

Investagators say the two are within the age of consent, and a grand jury wouldn’t necessarily issue an indictment. Sexual battery cases involving 17 year olds are hard to prove in court. There is a subsection that deals with strictly with a person in a position of authority or trust. Mississippi law singles out teachers, counselors, parents, doctors, ministers, even scout leaders and physical therapists among others, and forbids them from engaging in relationships with anyone under 18.

Bigham worked as a music teacher at DeSoto Central High. He’s charged with sexual battery and is in jail on $200,000 dollars bond.

SECTION 3. Section 97-3-95, Mississippi Code of 1972, is amended as follows:
(1) A person is guilty of sexual battery if he or she engages in sexual penetration with:
(a) Another person without his or her consent;
(b) A mentally defective, mentally incapacitated or physically helpless person;
(c) A child at least fourteen (14) but under sixteen (16) years of age, if the person is thirty-six (36)
or more months older than the child; or

(d) A child under the age of fourteen (14) years of age, if the person is twenty-four (24) or
more months older than the child.

(2) A person is guilty of sexual battery if he or she engages in sexual penetration with a child under the age of eighteen (18) years if the person is in a position of trust or authority over the child including without limitation the child’s teacher, counselor, physician, psychiatrist, psychologist, minister, priest, physical therapist, chiropractor, legal guardian, parent, stepparent, aunt, uncle, scout leader or coach.

SECTION 7. Section 97-5-21, Mississippi Code of 1972, which specifies the penalty for seduction of a child under the age of eighteen (18), is repealed.

Did these two kow what they were doing? Did Bigham take advantage of a state law to pursue a student? Is the student one of these “do whatever they want to” teenager? Will this be thrown out because they were dating, the district says they are unsure if the 17 year old senior girl was a student of his. This is what we use to call “Robbing The Cradle.”
